Smith explained that following the U.S. Supreme Court's ruling on presidential immunity, prosecutors revised the indictments by removing evidence they believed could no longer be used while retaining evidence they considered legally admissible. According to Smith, his office would not have continued pursuing the prosecutions unless prosecutors believed the remaining evidence could prove the charges beyond a reasonable doubt at trial.
