City Council Meeting Minutes CONDENSED VERSION 08-14-2018

Mayor Mike Werner called the meeting to order at 7:00 p.m. and led those in attendance in reciting the Pledge of Allegiance. Mayor Werner referenced the Open Meetings Act Poster at the entrance of the Community Meeting Hall. Council Members Chad Neuhalfen, Greg Rickers, Joe Dalton and John Hestermann were present. Other City Officials present were City Attorney Mark Fahleson, City Administrator Stephanie Fisher and City Clerk/Treasurer Clint Hlavaty. Also present were Nancy Meyer, Brandon Koll, Dan Habel, Deputy Dustin Buchheister, Captain Josh Clarke and the News Reporter Michael Wunder. Notice of the meeting and agenda were given to the Mayor and all Members of the City Council prior to the meeting. Notice of the meeting was posted at Russ’s Market Express, the US Post Office, the City Office and the City website (


Motion to approve the Consent Agenda as presented. Passed, Unanimous.


Emergency Medical and Fire Service Fees Hearing. Opened at 7:02 p.m.

Waverly Rescue Captain Nancy Meyer spoke about the fees currently charged and having the City research fees from other communities. Brandon Koll had some questions on the fees. Closed at 7:09 p.m.


Brandon Koll had questions on how the City handles bids and what is the process of bidding. Dan Habel asked about putting up a 10 foot fence on the back of his property that is adjacent the interstate to block noise. He knows the City has a six foot maximum height for fences and would like to see it changed.


Motion to approve claims in the amount of $191,548.48 Passed, Unanimous.


Motion to approve Consideration of Resolution 18-17 a resolution to establish and charge reasonable fees for emergency medical and fire service. Passed, Unanimous.

Consideration of Resolution 18-18 a resolution approving additional Volunteer Fire/Rescue Department member Jared Rains. Passed, Unanimous.


Motion to approve first reading Consideration of Ordinance 18-09 an ordinance of the City of Waverly, Nebraska, amending Chapter 10 of the Waverly Municipal Code pertaining to business regulations and sexually oriented businesses. Passed, Unanimous.


Motion to approve authorization of City Attorney to institute eminent domain proceeding relating to certain real property owned by Watermark Investments, LLC generally located at 9305 North 134th Street, Waverly, Lancaster County, Nebraska. Passed, Unanimous.

Motion to approve accepting the bid from RB Electrical, LLC for exterior lighting in the amount of $2910.00, for the City Office Building. Passed, Unanimous.

Motion to approve accepting the bid in the amount of $11043.56 from Clark Equipment Co dba Bobcat Company for a 90 inch mower and a 48 inch vibratory roller w/smooth drum. Passed, Unanimous.

Motion to postpone until next Council meeting the consideration of bid from Layne Western for VFD’s at Well #4 and Well #7. Passed, Unanimous.

Motion to postpone until next Council meeting the consideration of renewing League of Nebraska Municipalities Membership Dues for September 1, 2018 through August 31, 2019. Passed, Unanimous.

Discussion of 2018-2019 Budget Items. City Administrator Stephanie Fisher discussed the main requests from the following departments: Streets, Pool, Parks, General, Water, Waste Water, Cemetery.

Motion to extend the Council Meeting past 9:00pm. Passed, Unanimous.

The following Liaison Reports were given; Sheriff’s, Human Services, Public Works, Public Health, Fiscal and Economic Development and City Administrator.

Motion to Adjourn Meeting at 9:08 p.m. Passed Unanimous.
